property. You agree to release and discharge Imbabali Retreat & Venue and/or any affiliated
companies, their agents, members, officers, directors, employees, tour guides, volunteers and
representatives, from any and all liability for any loss, damage, or expense arising from or related to
this Tour.
Waiver & Release of Claims and Consent to Medical Treatment
 I consent to medical care and transportation in order to obtain treatment in the event of injury to me,
volunteers or medical professionals may deem appropriate and understand that this Waiver & Release
extends to any liability arising out of or in any way connected with the medical treatment and
transportation provided in the event of an emergency and/or injury.
 I understand and agree that I am expected to exhibit appropriate behaviour at all times and to obey all
local, provincial, civil and criminal laws at all times while participating in the Tour. This includes,
generally, respect for all people, equipment, facilities, or property. Imbabali Retreat & Venue and/or
any affiliated companies, their agents, members, officers, directors, employees, tour guides,
volunteers and representatives, may dismiss me, without refund, should my behaviour endanger the
safety of or negatively affect the Tour, person, facility, or property. I also agree to indemnify Imbabali
Retreat & Venue, and/or any affiliated companies, its owners, agents, members, officers, directors,
employees, tour guides, volunteers, Tour sponsors, representatives, past and present employees,
agents from any and all third party claims caused in whole or in part by my negligent or intentional
acts or omissions.
 I agree that Imbabali Retreat & Venue and/or any affiliated companies, their agents, members,
officers, directors, employees, tour guides, volunteers and representatives, is not responsible for any
personal items or property that is lost, damaged or stolen during the Tour.
 I consent to the use of my image in photographs, motion pictures or recordings taken during the Tour
for use in Tour advertising, marketing, or promotion. If you do not wish to be photographed or
recorded, please inform the Tour organizers in advance.
 I agree that all entry fee payments are final and non-refundable. Refunds may be done at the
discretion of Imbabali Retreat & Venue.
Health and Safety
 Clients must be in good health and physically fit to participate in activities.
 Clients must not be under the influence of any substances that impair their abilities.
 Consumption of alcohol is permitted only within designated areas.
 All facilities are used at own risk, especially the swimming pool, furrow, river, ponds, and dams.
Imbabali Retreat & Venue does not accept responsibility for any injuries or damage which may be a
result of utilising the facilities or any other injuries or damage visitors may suffer.
 Guns and ammunition are not allowed onto the premises and staff are not expected to take
responsibility for these items.
 No trail, motorbikes, quad bikes or similar vehicles are allowed.
 Please drive carefully on all the roads in the venue and do not exceed 20 km per hour. Children and
animals always have the right of way.
Smoking
Candles, incense, or smoking is NOT permitted inside any of our accommodation, restaurant or enclosed
areas. Smoking is permitted outside.
Conduct
 Clients are expected to exhibit appropriate behaviour and respect all local, provincial, and South
African laws.
 Alcohol - served only to attendees 18 years and older with a valid ID.
 No discrimination of any kind will be tolerated, including reverse discrimination. No abuse of any kind
will be tolerated. Any form of discrimination or abuse may result in removal from the Tour without a
refund.
 Rude language and swearing is not allowed. Any form of conduct by a guest/s, in the opinion of
Management, compromises the property or enjoyment of the venue by other guests, will result in
immediate expulsion from the property and the Tour, without any refund.
 Any form of misconduct, including excessive intoxication, may result in removal from the Tour without
a refund.
 Attendees are expected to drink responsibly and behave in a manner that ensures the safety and
enjoyment of all participants.
 Any person found to be damaging Imbabali Retreat & Venue property or that of other guests will be
evicted and will be held responsible for repair costs.
 Visitors must immediately report any breakage or fault on/to the premises to Management.
Cashless Venue
Imbabali Retreat & Venue is a cashless establishment. All purchases must be made using credit/debit cards
(not American Express Cards) or other accepted electronic payment methods.
Food/Beverages
 No food/beverages, other than that supplied by Imbabali Retreat & Venue, may be brought into the
restaurant & venue area. This includes the swimming pool.
 No alcoholic beverages or soft drinks in GLASS may be taken into the area around the swimming
pool(s) / dam(s).
Fireworks & Fire Regulations
 NO fireworks will be allowed on the Imbabali Retreat & Venue property. Fireworks are STRICTLY
prohibited. Use of any type of fireworks will result in immediate expulsion without any refund.
 No open fires, sparklers etc. are allowed.
 No releasing of helium balloons and / or sky lanterns.
 Fires may only be made in the braai facilities provided.
 No wood may be gathered from the property.
 Imbabali Retreat & Venue undertakes to fully comply with all applicable local fire and safety
regulations.
General Terms
 By joining the Tour, you agree to comply with all rules and regulations set forth by Imbabali Retreat &
Venue, written and verbal and/or any affiliated companies, their agents, members, officers, directors,
employees, tour guides, volunteers and representatives.
 Security is provided, but cars are parked at their own risk.
 We have a strict No Music, No Parties, and No Visitors at your accommodation Policy. We do not allow
day visitors at all. Similarly, you may not bring other guests who have not booked & paid upfront onto
the property of Imbabali Retreat & Venue. Guests must honour the peace and tranquillity of the
environment and may not play music or musical instruments at any time. After 22:00 there must be
absolute silence. Guests are specifically prohibited to play music from any car or sound system within
the boundaries of Imbabali Retreat & Venue, whether from a stationary or moving vehicle, no matter
what time of the day or night. We wish to emphasize that Imbabali Retreat & Venue is not a party
spot. No exceptions will be allowed. Imbabali Retreat & Venue only caters for guests who wish to relax
quietly in a tranquil environment whilst enjoying what nature offers.
 Any data collected during this booking will be stored on our computer(s). We will not share your
details with any third party.
 We do have large and small breed dogs that always roam freely. They will come and say “hello”. All we
ask is that you do not feed them and that you treat them with respect!
 Irritating mosquitoes, persistent flies, insects, terrible cell phone or Wi-Fi reception etc. are not of our
making.
 Imbabali Retreat & Venue shall not be liable for any unforeseen interruptions of services, including
electricity, loadshedding, water and sanitary and/or acts of nature.
 All fruit, vegetables, flowers, and plants growing on the farm are the property of Imbabali Retreat &
Venue. Please refrain from damaging, picking or removing any fruit, vegetable, plant, or flower.
 No littering of any kind, including cigarette buts, is allowed anywhere on the property of Imbabali
Retreat & Venue. Use the provided rubbish bins which are cleaned daily by our staff. No loud shouting
or screaming is allowed anywhere at Imbabali Retreat & Venue. Always respect nature and the
cleanliness of the area. You are subject to possible prosecution if you should inadvertently start a veld
fire.
 Imbabali Retreat & Venue and/or any affiliated Companies, their agents, members, officers, directors,
employees, tour guides, volunteers and representatives, shall at any time have the right to insist on
positive identification from any person who enters Imbabali Retreat & Venue to determine who has
made a valid reservation and thus the right to be at Imbabali Retreat & Venue, subject to these terms
and conditions.
 Lost and found - please contact us via the WhatsApp number +27(83) 311 1146 for help in tracing any
item(s) misplaced. Any items not claimed within 30 days of the departure date will be disposed of or
donated to charity.
 All accommodation rates are subject to change without prior notice.
 Imbabali Retreat & Venue reserves the right to amend these terms and conditions unilaterally from
time to time, as deemed fit and necessary.
Errors and Omissions Excepted (E & OE)
Imbabali Retreat & Venue has taken every care to ensure that the content of this document is accurate
and up to date. However, Imbabali Retreat & Venue accepts no liability for any errors or omissions. We
reserve the right to correct any errors or omissions and to amend these terms and conditions at any time
without prior notice.
Disclaimer
By entering the property, Imbabali Retreat & Venue, I, for myself, my heirs, personal representatives or
assigns, do so at my own risk and do hereby release, waive, discharge, indemnify and undertake not to sue
Imbabali Retreat & Venue, and/or any affiliated companies, their agents, members, officers, directors,
employees, tour guides, volunteers and representatives, who shall be absolved of any death, illness, injury,
theft, loss or damage of any kind sustained by any person, vehicle or animal, in any manner whatsoever. I
agree to adhere to the Terms & Conditions above.
I hereby knowingly renounce certain rights to which I would have been entitled. Children brought onto the
property are done so in accordance with the above and under the consent and supervision of the adult
whom they accompany. Right of admission is reserved.

LETTER OF CONSENT OR INDEMNITY
Introduction:
By reading and accepting this Letter of Consent and Indemnity, you agree to the terms and conditions
stated below. Please carefully review the contents of this document before proceeding.
Consent:
I, the participant/registrant (if 18 years of age or older) or parent/guardian of a participant/registrant (if
under 18 years of age), hereby consent to participate in The Magalies Screen Event organized by
Imbabali Retreat & Venue. I accept full responsibility for the actions and conduct of all people listed in
my booking (if any) and agree to ensure that these people, with their consent, comply with Imbabali
Retreat & Venue’s and/or any affiliated companies, their agents, members, officers, directors,
employees, volunteers and representatives’ rules and regulations.
I hereby agree to indemnify and hold harmless Imbabali Retreat & Venue’s and/or any affiliated
companies, their agents, members, officers, directors, employees, volunteers and representatives from
all claims, demands, damages, costs, or expenses arising out of or in connection with my participation in
the Event, including but not limited to:
● Personal injury, illness, or death
● Damage to or loss of personal property
● Any actions or omissions by Imbabali Retreat & Venue’s and/or any affiliated companies, their
agents, members, officers, directors, employees, volunteers and representatives.
I understand that participating in the Event involves risks, and I voluntarily assume all such risks. I also
confirm that I am medically fit to participate in the Event and that I have not been advised by a medical
professional to avoid such activities.
Assumption of Risk:
I acknowledge that participation in the Event involves inherent risks, including but not limited to:
● Physical exertion, injuries, or accidents.
● Unpredictable weather conditions.
● Encounters with wildlife.
● Equipment failure or negligence by third parties.
I voluntarily assume all risks associated with the Event, understanding that these risks may result in
injury, illness, property damage, or even death.
Indemnity:
I and all those listed in my booking (if any), with their consent agree to release, indemnify, and hold
harmless Imbabali Retreat & Venue’s and/or any affiliated companies, their agents, members, officers,
directors, employees, volunteers and representatives from any claims, liabilities, damages, costs, or
losses, including legal fees, or causes of action arising out of my participation in the Event, except where
caused by gross negligence or wilful misconduct. This indemnity shall apply to any personal injury,
damage to property, or any other loss incurred during or because of my/our participation. I agree to take
part in the activities at my own risk and understand that while every precaution is taken, some activities
can be dangerous.
Medical Declaration:
I declare that I am physically and mentally fit to participate in the Event. I have disclosed all relevant
medical conditions to Imbabali Retreat & Venue and understand that failure to do so may result in
exclusion from the Event.
Medical Treatment Authorization:
In the event of an emergency, I authorize Imbabali Retreat & Venue’s and/or any affiliated companies,
their agents, members, officers, directors, employees, volunteers and representatives to secure any
necessary medical treatment. I accept responsibility for any associated costs that may arise from such
treatment.
Insurance:
I acknowledge that it is my responsibility to secure personal travel and health insurance, including
coverage for medical emergencies, evacuations, and loss or damage to personal property.
Code of Conduct:
I agree to abide by the instructions of Imbabali Retreat & Venue’s officers, directors, employees,
volunteers, representatives and staff. I understand that any behaviour deemed unsafe, disruptive, or
contrary to local laws may result in my removal from the Event without a refund.
Photo and Media Consent
I grant Imbabali Retreat & Venue’s and/or any affiliated companies, their agents, members, officers,
directors, employees, volunteers and representatives' permission to capture photographs and videos of
me during the Event for marketing and promotional purposes. If not, I agree to advise the Event
Manager.
Understanding and Agreement:
I, acknowledge that I have read and fully understand this Letter of Consent and Indemnity. I agree to the
terms and conditions stated herein and confirm that I voluntarily enter into this agreement. The
participant agrees to abide by the rules and regulations that are laid down by the organisers, Imbabali
Retreat & Venue, and will endeavour to always be responsible in his/her participation of the program
during the Event.

Imbabali Retreat & Venue offers Payfast as a secure online payment gateway for services / purchases. All transactions are encrypted and processed in accordance with Payfast’s security protocols.

You must ensure that all information provided for the transaction is accurate and complete.
You are responsible for maintaining the confidentiality of your payment details.
You agree to notify Imbabali Retreat & Venue immediately of any unauthorized use of your payment information.
4. Imbabali Retreat & Venue Obligations

Imbabali Retreat & Venue will provide clear information regarding the total cost of your purchase/s.
Imbabali Retreat & Venue will ensure that all transactions are processed promptly and accurately.
5. Refunds and Cancellations

Imbabali Retreat & Venue’s refund and cancellation policies will be clearly communicated at the time of booking.
Any refunds due will be processed through the Payfast gateway in accordance with Imbabali Retreat & Venue’s policies.
6. Liability

Imbabali Retreat & Venue is not responsible for any issues arising from the use of the Payfast gateway that are outside of its control.
Imbabali Retreat & Venue’s liability in connection with the use of Payfast is limited to the extent permitted by law.
7. Changes to Terms

Imbabali Retreat & Venue reserves the right to modify these terms and conditions at any time.
Customers will be notified of any significant changes to the terms.
8. Governing Law

These terms and conditions are governed by the laws of South Africa, and any disputes will be subject to the exclusive jurisdiction of the courts in this location.
