These Terms & Conditions (“T&C”) form the basis of your agreement with Imbabali Retreat & Venue
for attendance at The Garden Route Wine Fest. By booking and/or attending the Event, you agree to
these T&C and accept responsibility for informing all members of your group. These T&C apply to all
attendees and anyone entering the venue.
1. Withdrawal and Cancellation Policy
1.1 In the event of cancellation due to Force Majeure, including but not limited to adverse weather,
riots, strikes, political unrest, terrorism, or any event beyond the control of Imbabali Retreat & Venue,
no entry fee or payment will be refunded.
1.2 If an attendee cancels their participation for any other reason, no refund will be provided.
2. Admission and Tickets
2.1 Tickets are non-refundable and non-transferable.
2.2 Imbabali Retreat & Venue reserves the right to refuse entry to any individual at its discretion.
2.3 All attendees must provide valid identification upon request.
3. Waiver, Assumption of Risk, and Consent to Medical Treatment
3.1 Attendees consent to medical care and transportation if required, including treatment deemed
necessary by volunteers or medical professionals.
3.2 Attendees are expected to behave appropriately and comply with all local, provincial, and national
laws. Behaviour that endangers safety or negatively affects the Event, property, or other participants
may result in dismissal without refund.
3.3 Attendees indemnify Imbabali Retreat & Venue, its owners, staff, and Event sponsors from all thirdparty claims arising from negligent or intentional acts or omissions.
3.4 Attendees acknowledge that Imbabali Retreat & Venue is not responsible for personal property lost,
stolen, or damaged during the Event.
3.5 Attendees consent to the use of images or recordings taken at the Event for marketing or
promotional purposes. Those who do not wish to be photographed must notify Event organizers in
advance.
3.6 All entry fee payments are final and non-refundable, except at the discretion of Imbabali Retreat &
Venue.
4. Venue Waiver & Release of All Claims
4.1 Attendees acknowledge that participation involves inherent risks, including injury.
4.2 Attendees release, absolve, indemnify, and hold harmless Imbabali Retreat & Venue, its owners,
staff, volunteers, sponsors, and all government entities from any claims, lawsuits, damages, or
expenses arising from participation.
5. Assumption of Risk
5.1 Participation at the Event involves inherent risks, including but not limited to challenging terrain,
wildlife, and weather conditions.
5.2 Attendees voluntarily assume all risks associated with participation.
6. Health and Safety
6.1 Attendees must be in good health and physically fit for participation.
6.2 Alcohol or substances that impair judgment must not be consumed outside designated areas.
6.3 All facilities, including swimming pools, rivers, dams, and furrows, are used at the attendee’s own
risk. Imbabali Retreat & Venue is not liable for injuries or damages.
6.4 Guns, ammunition, motorbikes, quad bikes, or similar vehicles are strictly prohibited.
6.5 Road speed limits are 20 km/h. Children and animals have right of way.
7. Smoking and Open Flames
7.1 Candles, incense, or smoking are not permitted indoors. Smoking is allowed only in designated
outdoor areas.
8. Conduct
8.1 Attendees must exhibit appropriate behaviour and respect all laws.
8.2 Alcohol will only be served to attendees 18 years or older with valid ID.
8.3 No discrimination or abuse of any kind will be tolerated. Violations may result in removal without
refund.
8.4 Rude, aggressive, or disruptive behaviour compromising safety, property, or enjoyment may result
in immediate expulsion without refund.
8.5 Attendees are expected to drink responsibly and respect the venue, staff, other guests, and
property.
8.6 Attendees are liable for any damage to property and must report any breakage to Management
immediately.
9. Liability Waiver
9.1 Imbabali Retreat & Venue is not responsible for loss, theft, or injury sustained during the Event.
9.2 Attendees release the venue and its staff from all claims arising from participation.
9.3 Owners, Management, and staff do not assume responsibility for personal property, injuries, or
damages.
10. Cashless Venue
10.1 The Event is cashless. All transactions must be made via credit/debit cards (excluding American
Express) or other accepted electronic payments.
11. Food & Beverages
11.1 Only food and beverages supplied by Imbabali Retreat & Venue may be consumed within the
venue.
11.2 No alcoholic beverages or soft drinks in glass containers are allowed near pools or dams.
12. Fireworks & Fire Regulations
12.1 No fireworks are allowed on the property. Violations will result in expulsion without refund.
12.2 No open flames, sparklers, helium balloons, or sky lanterns are allowed.
12.3 Fires may only be made in designated braai facilities. Gathering wood from the property is
prohibited.
12.4 The venue complies fully with all local fire and safety regulations.
13. General Terms
13.1 Imbabali Retreat & Venue is not wheelchair accessible.
13.2 The venue may cancel bookings in case of damage, fire, acts of nature, strikes, or other
uncontrollable events without liability, while attempting to assist in securing alternative arrangements.
13.3 Cars are parked at the owner’s risk.
13.4 Outdoor events may be disrupted by weather; Imbabali Retreat & Venue is not liable.
13.5 Interruptions of services (electricity, water, Wi-Fi) are not the responsibility of the venue.
13.6 All flora, trees, and plants on the property are protected. Picking or damaging plants is prohibited.
13.7 Children must always be under the direct supervision of a responsible adult while on the
property. Due to the presence of open water, including dams, a river, furrow and swimming pools,
minors may not be left unattended anywhere on the grounds.
13.8 Imbabali Retreat & Venue reserves the right to close the bar at its discretion to protect property,
guests, or staff.
13.9 Animals: Only approved social dogs allowed; all other pets are prohibited. Dogs must have up-todate vaccinations, be free from ticks/fleas, and behave responsibly.
13.10 Loud shouting or disruptive behaviour is prohibited. Respect the natural environment.
13.11 No littering; use provided bins.
13.12 Management may request ID verification at any time.
13.13 Lost property inquiries via WhatsApp +27(83) 311 1146. Items unclaimed after 30 days will be
donated to charity.
13.14 Data collected will be stored securely and not shared with third parties.
13.15 Imbabali Retreat & Venue reserves the right to amend these T&C at any time.
14. Errors and Omissions Excepted (E&OE)
14.1 Every effort has been made to ensure accuracy. Imbabali Retreat & Venue accepts no liability for
errors or omissions.
14.2 We reserve the right to correct errors and amend T&C without prior notice.
15. Disclaimer
15.1 By entering the property, attendees release, waive, discharge, and indemnify Imbabali Retreat &
Venue, its owners, staff, and affiliates from any death, injury, illness, loss, or damage to persons,
vehicles, or animals.
15.2 Children may only attend under the supervision of an adult who assumes responsibility.
15.3 The venue reserves the right of admission to all attendees.

Introduction:
By reading and accepting this Letter of Consent and Indemnity, you agree to the terms and conditions
stated below. Please carefully review the contents of this document before proceeding.
Consent:
I, the participant/registrant (if 18 years of age or older) or parent/guardian of a participant/registrant (if
under 18 years of age), hereby consent to participate in The Garden Route Wine Fest organized by
Imbabali Retreat & Venue. I accept full responsibility for the actions and conduct of all people listed in my
booking (if any) and agree to ensure that these people, with their consent, comply with Imbabali Retreat
& Venue’s and/or any affiliated companies, their agents, members, officers, directors, employees,
volunteers and representatives’ rules and regulations.
I hereby agree to indemnify and hold harmless Imbabali Retreat & Venue’s and/or any affiliated
companies, their agents, members, officers, directors, employees, volunteers and representatives from
all claims, demands, damages, costs, or expenses arising out of or in connection with my participation in
The Garden Route Wine Fest, including but not limited to:
Personal injury, illness, or death
Damage to or loss of personal property
Any actions or omissions by Imbabali Retreat & Venue’s and/or any affiliated companies, their
agents, members, officers, directors, employees, volunteers and representatives.
I understand that participating in The Garden Route Wine Fest involves risks, and I voluntarily assume all
such risks. I also confirm that I am medically fit to participate in The Garden Route Wine Fest and that I
have not been advised by a medical professional to avoid such activities.
Assumption of Risk:
I acknowledge that participation in The Garden Route Wine Fest involves inherent risks, including but not
limited to:
Physical exertion, injuries, or accidents.
Unpredictable weather conditions.
Encounters with wildlife.
Equipment failure or negligence by third parties.
I voluntarily assume all risks associated with The Garden Route Wine Fest, understanding that these risks
may result in injury, illness, property damage, or even death.
Indemnity:
I and all those listed in my booking (if any), with their consent agree to release, indemnify, and hold
harmless Imbabali Retreat & Venue’s and/or any affiliated companies, their agents, members, officers,
directors, employees, volunteers and representatives from any claims, liabilities, damages, costs, or
losses, including legal fees, or causes of action arising out of my participation in The Garden Route Wine
Fest, except where caused by gross negligence or wilful misconduct. This indemnity shall apply to any
personal injury, damage to property, or any other loss incurred during or because of my/our
participation. I agree to take part in the activities at my own risk and understand that while every
precaution is taken, some activities can be dangerous.
Medical Declaration:
I declare that I am physically and mentally fit to participate in The Garden Route Wine Fest. I have
disclosed all relevant medical conditions to Imbabali Retreat & Venue and understand that failure to do
so may result in exclusion from the Event.
Medical Treatment Authorization:
In the event of an emergency, I authorize Imbabali Retreat & Venue’s and/or any affiliated companies,
their agents, members, officers, directors, employees, volunteers and representatives to secure any
necessary medical treatment. I accept responsibility for any associated costs that may arise from such
treatment.
Insurance:
I acknowledge that it is my responsibility to secure personal travel and health insurance, including
coverage for medical emergencies, evacuations, and loss or damage to personal property.
Code of Conduct:
I agree to abide by the instructions of Imbabali Retreat & Venue’s officers, directors, employees,
volunteers, representatives and staff. I understand that any behaviour deemed unsafe, disruptive, or
contrary to local laws may result in my removal from The Garden Route Wine Fest without a refund.
Photo and Media Consent
I grant Imbabali Retreat & Venue’s and/or any affiliated companies, their agents, members, officers,
directors, employees, volunteers and representatives' permission to capture photographs and videos of
me during The Garden Route Wine Fest for marketing and promotional purposes. If not, I agree to advise
the Wine Fest Manager.
Understanding and Agreement:
I, acknowledge that I have read and fully understand this Letter of Consent and Indemnity. I agree to the
terms and conditions stated herein and confirm that I voluntarily enter into this agreement. The
participant agrees to abide by the rules and regulations that are laid down by the organisers, Imbabali
Retreat & Venue, and will endeavour to be responsible in his/her participation of the program during The
Garden Route Wine Fest at all times.
